| Terms And ConditionsTerms and ConditionsDefinitions In these terms and conditions the following meanings shall apply. 1.1 'We', 'Us' and 'Our' means The Networking Company (Scotland) Ltd 1.2 'You' means the person, company, their employees or agents seeking to purchase goods from us or use our services 1.3 The 'goods' means new or used goods, parts or accessories and services provided by us. 1.4 The statutory rights of consumers are not affected by these terms.
2.1 All orders are accepted by us only under these terms and conditions which may not be altered other than with our written agreement. 2.2 These terms and conditions are deemed to be accepted by you when an order is placed with us. 2.3 Quotations are valid for 7 working days from original date unless otherwise stated. 2.4 Orders accepted by us may only be cancelled with our written agreement and you will indemnify us against all losses including loss of profit, damages, costs and expenses occurred as a result of that cancellation. 2.5 We shall not be held responsible for the suitability of any goods supplied by us for your individual needs. All images, photographs, descriptive material and specifications on our website are for the sole purpose of giving an approximate idea of the goods.
3.1A. Credit Accounts. If we have approved your application to hold a credit account with us, your account is due for payment within 30 days of the invoice date. Accounts that become overdue shall attract interest charged at 6% above bank of England base rate and you will be liable for all costs incurred in the recovery of the debt including 3 rd party collection fees, legal and all court costs. Credit accounts may be withdrawn at any time without prior notice being given. 3.1B Purchase orders must be received by us by fax, email or post before goods will be dispatched 3.2 Non Credit accounts. Acceptance of an order will only take place upon confirmation of your payment. No other correspondence will be taken as acceptance of an order. 3.3 We accept MasterCard, Visa, Switch and solo cards. Credit cards incur a 2.5% surcharge. Debit cards incur no surcharge. 3.4 All cheque and BACS payments must be cleared before any goods will be dispatched. You must allow up to 7 working days for clearance. 3.5 Title to the goods remains with us until we are in receipt of payment in full. (Cleared Funds) 3.6 All prices quoted or displayed are in UK pounds sterling and are exclusive of VAT and delivery. A delivery charge will be made and clearly shown in the shopping basket before an online order is completed. If the price published on the website is incorrect due to an error or omission we have the right to terminate an order or quote provided the goods have not been dispatched. In the event of an error in pricing we will inform you of the correct pricing and give you the opportunity to cancel the order. 3.7 All orders placed on our website are checked and must be positively sanctioned prior to dispatch. We accept no responsibility for error made by you in providing your details and we accept no responsibility for any order delayed as a result of incorrect or unsubstantiated details. 3.8 You may not withhold payment of any invoice or the amount due to us by reason of any right of set off or counterclaim which you may have or allege to have for any reason whatsoever.
4.1 All new goods have a manufacturers warranty and support. Warranty registration should be carried out in accordance with manufacturer's guidelines and any faults should be dealt with directly with the manufacturer unless otherwise stated by us. Where these goods are returned to us to process, a £25.00 administration fee plus costs will be charged. 4.2 Original packaging should be retained in case a return becomes necessary. Where you no longer have the original packaging, adequate packaging must be used and the goods insured against damage during transit.
5.1 Delivery charges are displayed in the shopping basket and are applicable to UK mainland addresses only. Non-UK mainland addresses may incur a delivery surcharge and delay in delivery time. Please contact us with your postcode for an accurate delivery cost and time. 5.2 Delivery will only be made to the registered card user’s address and must be signed for. Delivery to an alternative address is at our sole discretion and we will require further personal details before consent is given. 5.3 Goods should be inspected before signing for the delivery or else signed for as 'unchecked'. Failure to do so means we are not responsible for damage incurred during transit. Any damaged goods must be reported to us within 24 hours in order for us to make a claim. 5.4 Any shortages must be reported to us within 24 hours of the delivery and our liability for a short delivery is limited to making good the shortage. 5.5 We will endeavor to deliver your goods within 2-5 working days with the exception of weekends and public holidays but time shall not be of the essence. If we are unable to deliver the goods for any reason you will be notified and will not be obliged to pay for the goods. If delivery of the goods is delayed beyond 10 working days you will have the option to cancel the order. We shall not be liable for any loss which may be caused by delay in delivery
6.1 Non faulty goods returned within 7 working days for refund are liable to a 20% restocking fee and will only be accepted back providing the product is returned unused in its original packaging, in unmarked condition and complete with all packaging, accessories and any software supplied must be unopened and unregistered. 6.2 Only faulty goods may be returned after 7 days for refund where we are unable to replace or repair the goods within a reasonable time. 6.3 You shall not be entitled to a refund or replacement of damaged goods if the defect arises out of failure to follow manufacturer's instructions as to use, installation, commissioning or maintenance of the goods or you alter or repair the goods without prior consent.
